Privacy Policy

This Privacy Policy governs the manner in which SpeakUp LLC ("SpeakUp") collects, uses, maintains and discloses information collected from users (each, a "User") of the getspeakup.com website and its related software application and platform ("Site"). This privacy policy applies to the Site and all products and services offered by SpeakUp. Capitalized terms used but not defined herein shall have the meaning assigned to them in our Terms of Service.

Personal Identification Information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our Site, register on the Site, make payments on the Site, and in connection with other activities, services, features or resources we make available on our Site. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

In order for a User to have full access to the Site, they will need to create a SpeakUp account by providing certain contact and identifying information and other personal information as indicated on the relevant forms on the Site. Where possible, on these forms we indicate which fields are required and which fields are optional. You always have the option to not provide information by choosing not to become a registered User or by not using the particular feature of the Site for which the information is being collected.

Contact Data

Contact Data includes name, address, phone number, profile information, email address, title, time zone and other contact information that we may collect through your administration and use of the Site by you and others. Contact Data you provide as part of your SpeakUp profile is available to other Members of your SpeakUp Corporate Network(s).

SpeakUp works better when more people take part in communicating and sharing on a Corporate Network. For this reason, SpeakUp encourages people to send invitations to others who are not yet on the Site. If you choose to provide us with email addresses or other Contact Data of people inside or outside your organization, we will use that information to enable you and other Users to invite those people to join the appropriate Corporate Network. We may also use such information to send emails regarding company news, updates, related product or service information, or request your feedback. If at any time the recipient of such emails would like to unsubscribe from our mailing list, we include detailed unsubscribe instructions at the bottom of our emails.

We may also use Contact Data to contact you or others to provide information about new subscriptions, billing and important updates about the Site, including information about security or other technical issues. SpeakUp also uses Contact Data to complete the transactions you request, administer your account, improve the Site, detect and prevent fraud and to contact you regarding third-party inquiries as described herein or the Terms of Service.

Usage Data

We may use statistical data, analytics, trends and usage information derived from your use of the Site ("usage data"). Usage data includes, for example, aggregated quantitative information about active users, activity, topics, and groups. Some ways we use the usage data include operating, improving and personalizing the Site and our offerings, as well as other products and services, and providing reports to you or your Corporate Network’s Corporate Administrator.

Content Data

Content Data is all the data, including all text, sound, software or image files that you provide, or are provided on your behalf, to us through your use of the Site.

We make no claim of ownership in your Content Data. We don’t share your Content Data with advertisers, or with anybody else except in the very limited circumstances described herein, the Terms of Service or other agreements between you and SpeakUp.

Generally, information you provide that we use or store may be used to helps us respond to your customer service requests and support needs more efficiently.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies

Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

How We Protect Your Information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Sharing Your Personal Information

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys and processing payments. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

We will not disclose your information to a third party (including law enforcement, other government entity, or civil litigant; excluding our subcontractors), except as you direct or unless required by law. If legally compelled to disclose your information to a third party, we will use commercially reasonable efforts to notify you in advance of a disclosure unless legally prohibited.

User Anonymity

The purpose of the Site is to provide a venue for discussing ideas and creating solutions for employees and employers. The Site may provide the option for Users to post Content Data and comments anonymously. Users, including Company Administrators, of the Site will not know who posted such post or comment. All Members agree to adhere to the concept of anonymity. In cases where the identity of any individual or company becomes known, all parties agree that all information will be treated as 100% anonymous. Company Administrators may at any time upgrade their administrative control over the Corporate Network, resulting in their ability to remove the Anonymous posting feature on an organization’s Corporate Network. If the Corporate Administrator removes this feature, all anonymous Content Data posted prior to the removal of this feature, will remain "anonymous" on the Site.

Accessing, Correcting and Deleting Your Information

You may access, correct or delete Content Data or Contact Data you have provided to us by using the tools within the Site (for example, editing your profile information on the Service) or by contacting us. Changes you make to your information on the Site take immediate effect on your Corporate Network, but data will be retained in secure storage for a limited period afterward as part of our standard data backup process.

Registered Users within your Corporate Network (including Company Administrators) may view voluntarily provided content and information posted by you on your organization’s Corporate Network. Registered Users may create Private Groups within a Corporate Network to minimize the amount of Users able to view certain Content that is posted on the Site. Corporate Administrators may decide to purchase at any time greater administrative control of the Corporate Network, resulting in greater access to the content and information that you provide to the Site.

Changes to This Privacy Policy

The company has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your Acceptance of These Terms

By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
